RELEASE OF LIABILITY AND INDEMNITY AGREEMENT
Please read this release carefully before signing. This release must be executed and submitted before you will be able to participate in this activity. In consideration, the receipt and sufficiency of which is hereby acknowledged, for (attendee as stated in the purchase form), being allowed to participate in the KMS CC Booster Cheer Clinic, to be held on September 26, 2026 at Kingwood Middle School , and in any related events and activities (collectively the “Activities”), the undersigned hereby enters into this RELEASE OF LIABILITY AND INDEMNITY AGREEMENT (“Agreement”) with the Humble Independent School District, as of the date below and acknowledges and agrees as follows:
1. I recognize and understand that there are risks associated with my participation in the Activities including but not limited to, bodily injury or death and damage to property. I expressly recognize that my participation in the Activities may involve physical contact with another person. I further acknowledge and understand that I will be held responsible for any and all damages to persons or property caused by my participation in the Activities.
2. FOR MYSELF, SPOUSE AND/OR CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, and assume full responsibility for my participation in the Activities.
3. I willingly agree to comply with the stated and customary terms and conditions for participation established for the activity. If I observe anything unusual during the course of our participation in the Activities or if I have any significant concern regarding the readiness to participate in the Activities, I will remove myself, my spouse, and/or my child from participation in the Activities and immediately bring this to the attention of the nearest organizer or official.
4. I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, ACQUIT AND FOREVER DISCHARGE AND WAIVE all claims against Humble Independent School District, its officers, directors, agents and/or employees (“RELEASEES”), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property arising out of or incident to our involvement or participation in the Activities, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
1. I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above RELEASEES from any and all liabilities incident to my involvement or participation in the Activities, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law.
2. As further inducement to permit my child (if applicable) to participate in the Activities, I represent that I thoroughly and completely understand that this is a complete and final release and indemnity agreement, that I am freely and voluntarily entering into this Agreement, that no representations, promises or statements made by any RELEASEES, or any agent or other representative of any RELEASEES has influenced me to sign this Agreement.
3. This Agreement shall be construed, governed and enforced in accordance with the laws of the State of Texas, and the jurisdiction and venue for the resolution of any and all disputes arising from the Agreement shall lie exclusively in the state or federal courts of Harris County Texas.
I UNDERSTAND THE SERIOUSNESS OF THE RISKS INVOLVED BY PARTICIPATING IN THE ACTIVITIES, MY PERSONAL RESPONSIBILITIES FOR ENSURING ADHERENCE TO RULES AND REGULATIONS, AND ACCEPT THEM AS A PARTICIPANT OR THE PARENT OF A PARTICIPANT. I HAVE READ THIS RELEASE OF LIABILITY AND INDEMNITY AGREEMENT, I FULLY UNDERSTAND ITS TERMS, I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING THIS RELEASE OF LIABILITY AND INDEMNITY AGREEMENT, AND I SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
